Applications of the General Conditions of Sale

These General Conditions of Sale (hereinafter GCS) govern the contractual relationship and transactions between:

SARL Rourou et Luli with capital of 1,000 euros, registered in the Perpignan trade and companies register under number 842 731 622 , whose registered office is located at 8 rue Juan Morata 66700 ARGELES SUR MER, France, operating under the trade name ROUROU et LULI (hereinafter Seller)

and any natural person of full age and legally capable, consumer (hereinafter Customer) placing an order for clothing and/or costume jewelry (hereinafter Products) through the online store via the website www.rouroululi.com (hereinafter Site), online commerce site accessible to any user of the Internet network.

The General Terms and Conditions of Sale are binding on the Customer who declares to have read and accepted them by checking the box "I accept the General Terms and Conditions of Sale" before implementing the online ordering procedure.

All orders placed on the website are subject to these general terms and conditions of sale. These are subject to change and update; the terms and conditions applicable to a customer's order of a product are those in effect on the day the order is placed.

These general conditions of sale are subject to French law and can be viewed in French.

1. Products

The products offered for sale are those appearing on the site www.rouroululi.com , on the day the Customer consults the site.

The products comply with the requirements of French law in force on the date they are put on sale, relating to the safety and health of people, fairness in commercial transactions and consumer protection.

Products are available for sale while stocks last.

The products offered for sale are described with the greatest possible accuracy. However, if errors or omissions occur in this presentation, Rourou et Luli cannot be held liable.

The photographs and texts illustrating the products are for informational purposes only and have no contractual value.

2. Price

Prices are shown in Euros including all taxes (TTC) including Value Added Tax (VAT) and excluding delivery costs, the latter will be indicated when the order is confirmed.

In the event of delivery outside the European Union and to the French Overseas Territories, the user is informed that customs duties and other taxes may be payable. The necessary formalities and payment of said duties and taxes are not the responsibility of Rourou et Luli and will in any event be the responsibility of the user.

It is therefore the latter's responsibility to check all of this data as well as the possibilities of importing the product with the competent authorities of the country of delivery, before any order on the site.

3. Order

To place an order, the Customer may select one or more products and add them to their basket. Once their order is complete, they may access their basket by clicking on the button provided for this purpose. By consulting their basket, the user will be able to check the number and nature of the products they have chosen and will be able to check their unit price as well as the total price of the order. They will have the option to remove one or more products from their basket.

If the Customer has not already done so, he will be prompted to identify himself or register.

After logging into the site and validating your shopping cart, an automatically completed online form summarizing the prices, applicable taxes and delivery costs is displayed to the Customer.

The Customer is invited to carefully check the contents of his order (the quantity and references of the products ordered and the price) before clicking on the “Validate” button.

The Customer must also indicate the chosen delivery method by selecting it in the “Delivery” section of the site.

Once logged in or after having fully completed the form, the Customer will be asked to check or modify their delivery and billing details, to confirm their order and then will be asked to make their payment by being redirected to the secure payment interface.

Any order constitutes express and irrevocable acceptance of the prices and descriptions of the products available for sale.

The Seller reserves the right to cancel or refuse any order from a Customer with whom there are difficulties related to previous orders.

The Seller notifies the Customer by email of the dispatch of the order.

The Customer declares that they have read and accepted these terms and conditions of sale before placing their order. Validation of the order constitutes acceptance of the general terms and conditions of sale.

4. Payment

The amount owed by the Customer is payable in full when ordering the product.

For payment by credit card, the debit is made when you place your order on the condition that you have obtained prior authorization to debit your account from the competent payment centers, failing which your order cannot be taken into account.

Online payment by credit card is made via the SSL "Secure Socket Layer" security system which allows the encryption of your bank details during their transmission over the network.

The Seller reserves the right to suspend or cancel any order in the event of difficulties encountered in collecting payment.

The company Rourou et Luli retains full ownership of the products sold until full payment of all sums owed by the customer in connection with their order, including fees and taxes.

5. Delivery

Packages are generally shipped within 48 hours of receipt of payment, but may take 2 to 4 days, unless otherwise specified on the site in the event of exceptional closure where deliveries will be delayed.

The standard shipping method is Colissimo from La Poste. For deliveries abroad, the shipping method is Colissimo International with tracking number. Customs fees and taxes of all kinds, which are not included in the total price and are the buyer's responsibility, may be requested.

In the event of a failure attributable to the carrier (e.g. damage noted on the package), the Customer is required to express reservations and file a complaint with the Post Office within 2 days of receipt of the order.

Shipping costs include packaging, handling and postage.

From the time the order is shipped, the average delivery times are as follows: 2 to 5 working days by standard Colissimo for France and 5 to 10 working days by Colissimo International for abroad.

6. Return and Refund

The right of withdrawal is exercised by the customer at their discretion: the customer who returns the item does not have to provide reasons or pay a penalty.

The Customer has 14 days to return their item(s) from the date of receipt of their order.

Only returns in the original packaging and in perfect condition for resale (labeled, not damaged, damaged or soiled, etc.) will be accepted.

After this period, the products delivered will be deemed compliant and accepted by the Customer and the company Rourou et Luli may reserve the right to refuse the return and reimbursement.

The refund of the amounts paid will be made within a maximum of 30 days after receipt of the product(s), excluding shipping costs and any taxes related to this return.

The refund will be made to the Customer's bank card.

All return costs are the responsibility of the Customer who has exercised their right of withdrawal.

7. Dispute and Liability

These general terms and conditions of sale are subject to French law. In the event of a dispute, the parties undertake, before any legal action, to seek an amicable solution. If no agreement is reached, the Commercial Court of Perpignan shall have sole jurisdiction.

The company Rourou et Luli cannot be held responsible for the non-performance of the contract concluded, on the one hand in the event of force majeure (in particular disruption or total or partial strike, in particular of postal services and means of transport or communications, natural disasters, fires, water damage, etc.) and on the other hand in the event of fault of the customer.

The company Rourou et Luli cannot be held responsible for the consequences resulting from the misuse of the products sold on the site https://www.rouroululi.com and its liability cannot be incurred for damage resulting from the use of the internet network such as loss of data, intrusion, virus, interruption of service, or other involuntary problems.

8. Intellectual Property

The Client acknowledges that the models proposed, the textual and graphic contents, the concept, the name, the image and the graphic charter conveyed by the company Rourou et Luli are the exclusive property of the company Rourou et Luli, in particular under the title of intellectual property, for the entire duration of protection of these rights and for the entire world.

No reproduction is authorized without our prior consent.

9. Protection of personal data

In accordance with Law No. 78-17 of January 6, 1978 relating to information technology, files and freedoms, the Client may obtain communication and, where applicable, modification, rectification or deletion of information concerning him/her.

The seller undertakes not to communicate to third parties the personal data provided by the Customer, unless required to do so by legal provisions or by court order.
